HOW THEY MEDIATED IN THE MIDDLE AGES:
A FEW LESSONS FOR OUR TIMES
An appreciation by Phillip Taylor MBE and Elizabeth Taylor of Richmond Green Chambers
As the title indicates, this is one of Derek Roebuck’s scholarly and invariably engaging examinations of the ways and means by which disputes were settled in times past. His earliest work dealt with Ancient Greece. This one, the fourth in the series, concerns dispute resolution in England during the Middle Ages from 1154 to 1558.
The dates are significant. AD 1154 marked the start of Henry II’s reign and the tentative beginnings of the English Common Law. By the time of Elizabeth I in 1558 a new period in the development of the English legal system began to emerge.
Remarkably, although perhaps not unexpectedly a thorough and detailed survey like this of dispute resolution during the medieval period encompasses just about every aspect of human activity and human concerns. Arbitration as a focus of study therefore, will inevitably touch upon legal, political and social history and literary history as well.
For example --would you believe – the first known usages of the words ‘mediation’ and ‘arbitration’ have turned up in the works of Geoffrey Chaucer. ‘Arbitration’ appears first in Chaucer’s ‘Melibeus’ and in the Canterbury Tales, the Man of Law’s Tale shows the lawyer telling the story of the Sultan of Syria wishing to marry a Christian princess. ‘What need is there for disputation…or even for the Pope’s own mediation….’ etc. etc.
Note that all this is no mere literary curiosity. Chaucer, a diplomat by profession who studied law possibly in Lincoln’s Inn, was apparently involved in the negotiations that brought about the Peace of Calais in 1360. Dispute resolution was evidently just one of his areas of expertise.
Of course, this is only one example of the wealth of insight and anecdote contained in this book, published by Holo Books, the Arbitration Press, Oxford. It reveals the Middle Ages as a vibrant and sophisticated era in which dispute settlement ideally emanated from within communities and generally depended on arriving at an agreement between the disputatious parties, rather than having a decision imposed on them by a superior authority.
It seems that just about every community in medieval life would or could be involved in settling disputes. Following a description of the historical setting and the legal system, the book examines the dispute settlement role of such groupings as cities and boroughs, lords and councils, the various guilds, the Jewish community, universities, the Church and a lot more. Women also rate a separate chapter in which there’s a section on women as arbitrators. They performed ‘exactly the same roles as men’ when the social conditions allowed, but --no surprise here -- they had to be of high rank.
From land ownership to serious felonies, an amazingly wide range of mediation and arbitration matters are discussed in this important book, but you don’t have to be a lawyer, a mediator, or an arbitrator to enjoy it. With his careful and copious use of original sources, the author builds a picture of the medieval period that will certainly enchant history devotees keen to enhance their understanding of this particularly fascinating era.

Swansea, officially known as the City and County of Swansea, is a coastal city and county in Wales. Swansea is the second largest city in Wales after Cardiff, and the twenty-fifth largest city in the UK.
Swansea lies within the historic county boundaries of Glamorgan and the ancient Welsh commote of Gŵyr. Situated on the sandy South West Wales coast, the county of Swansea area includes the Gower Peninsula and the Lliw uplands.
The City and County of Swansea local authority area is bordered by unitary authorities of Carmarthenshire to the north, and Neath Port Talbot to the east. Swansea is bounded by Swansea Bay and the Bristol Channel to the south. Swansea can be roughly divided into four physical areas. To the north are the Lliw uplands which are mainly open moorland, reaching the foothills of the Black Mountain. To the west is the Gower Peninsula with its rural landscape dotted with small villages. To the east is the coastal strip around Swansea Bay. Cutting though the middle from the south-east to the north-west is the urban and suburban zone stretching from the Swansea city centre to the towns of Gorseinon and Pontarddulais.
Swansea City A.F.C. (founded 1912) is the city's main football association team. Originally playing at the Vetch Field, they moved to the Liberty Stadium at the start of the 2005–2006 season, winning promotion to League One in their final year at their old stadium. The team presently play in the Premier League, after being promoted during the 2010/11 season. The Football Association of Wales had decided that for the Euro 2012 qualifying campaign, Wales would play all of their home ties at either the Cardiff City Stadium or the Liberty Stadium. Swansea has three association football clubs that play in the Welsh Football League: Garden Village, South Gower and West End.
