The Nelson Mandela Foundation has told the Equality Court sitting in Johannesburg that displaying the old South African flag, the flag of the Apartheid government, should be declared hate speech.
The foundation says that the flag is a symbol of racism and prejudice, and is a reminder of how white people treated black people during Apartheid. But the organisation Afriforum says that banning displays of the flag in this way would amount to ban on the flag itself.
It says that banning the flag would infringe on the Constitutional right to freedom of expression.

Judgment on apartheid flag | Nelson Mandela Foundation wants old SA flag to constitute hate speech
Judgment in the Apartheid Flag case will be delivered at the Johannesburg High Court this morning. In February 2018, the Nelson Mandela Foundation announced that it had made an application to the Equality Court for an order declaring that gratuitous displays of the old official flag of apartheid South Africa constitute hate speech, unfair discrimination and harassment based on race. The matter was opposed by AfriForum NPC.

Indian PM in South Africa, scheduled to visit Nelson Mandela Foundation
Indian Prime Minister, Narendra Modi, has landed in South Africa on the second leg of his 4-nation African tour.
He flew into Waterkloof Airforce Base in Pretoria on Thursday night after concluding a one-day visit to neighbouring Mozambique.
According to the South African government, the visit by the Indian premier will be used to further bolster cooperation in economic, political, social and international areas.

Old flag saga | Nelson Mandela Foundation and AfriForum at Equality Court over flag
The foundation says the old flag was a symbol of what the United Nations said was a crime against humanity and that its public display celebrates that crime.
Lobby group - AfriForum is opposing the application on the basis that the order being sought would infringe on South Africans' right to freedom of expression.
The South African Human Rights Commission and Johannesburg Pride are supporting the application.
The old flag controversy resurfaced following the BlackMonday protests against farm murders in 2018.
