NO IMPACT ON EUGENE HOMELESS BEYOND AGGRESSIVE TICKETING THIS MORNING
Please be aware of the above decision from the United States District Court of Appeal, 9th Circuit, which was broadcast widely on the 5th of September. The homeless & advocates everywhere were thrilled because it basically read: Sleeping on the Streets or Public Places CAN NOT be outlawed and doing so is tantamount to Cruel and Unusual Punishment. That was it in a nutshell as the 32 page Decision reads to the normal thinking reasonable person!
Well... Not to my surprise at 52..... Sadly....... This is not how the powers that be in Eugene read the document. Through the absolute eyes of one looking only to determine if they are in trouble for this????? (or) Is what we are doing wrong like that says???? (or) How can we figure out how this does not apply to our way of law enforcement???? (or) We don't have to do that and I will show you why we are exempt from that Decision!
How exactly does one go about looking at that document and continue operations as usual? How exactly do the powers that decide in Eugene Oregon, heres how. Sleep disruption was not the curel part they speak of. Sleep disruption daily was not the unusual part they speak of. Jail is the treat, and we don't arrest for sleep. Eugene is taking a page out of the book of loophole your way through anything, not change and grandfather it in, or ignore it completely.
Well here is my unbarred opinion: Lets say, I am poor / indigent, with no mailing address or means of easy contact, and I listen to every word the officer say and understand very well.
But let's say, I don't read well. The officer duly explains: this is a violation its is not a crime or criminal offence, you do not have to worry about a warrant or being arrested because I am only nudging you with my foot and waking you up from a sound sleep at 7am to let you know you can not camp here on the streets. I am not here to arrest you. But can you sit up now and can I have your ID / Name and DOB. For this simple no big deal violation.
I have to let you know that this is not a mandatory court appearance, but if you would like to plead not guilty then there is a date here at the bottom, just report to the address here or mail it in and let them know you want a trial. But if you don't it just is defaulted as guilty.
Seems correct that it is not going to cause anyone jail potentially just on the sole basis of being homeless and sleeping. WRONG WRONG WRONG perhaps?
My belief is the cruel and unusual punishment that is being protected in the 8th amendment, begins with the single Act of Waking a Sleeping HUMAN. Then, telling them as happened today that they do not have to wake-up in a bad mood. Having to pee so bad you want to bust. Being told what to do ordered really, sit down on your bottom, no squatting is not alright or your are going into handcuffs if you can't on your bottom all the way. Watching your 3 other friends be harrassed for what you know to be crazy wrong regardless of law. To me that is the cruel and unusual.
NEXT: you remember you have the ticket and choose to not fight it! boo on you but, ok no fight. no not guilty trial request. you then give it no more thought. except there is that silly little fact that if you don't go and pay the $140 owed for that violation.
As stated on the ticket clearly, you suffer the potential WARRANT FOR YOUR ARREST! not for the act in the violation but for the debt.
To me same threat of restriction of Liberty and Freedom, same Cruel and Unusual that is pinopinted in the Decision for all the reason above not just incarceration, but in the eye of loophole that is not arresting and or jailing anybody for sleeping.
REALLY? that's not the path to heaven!
I thought yesterday and the day before were the most amazing since I was returned my weed pipe by Denver Police after getting out of jail there, and it was even full still.
But the 9th Circuit Decision beat that and most amazing moments before that I have witness crazy amazing things, both good or bad. Thought this was a great day, and I was high on the Court Decision for 48 hours.
Then EPD burst my bubble this morning very well. Causing the penning of this letter you just read, and additional measures which may conclude Requesting Injunctive Relief will follow.

Boylston Street is the name of a major east-west thoroughfare in the city of Boston, Massachusetts. The Boston street was known as Frog Lane in the early 18th century and was later known as Common Street. It was later again renamed for Ward Nicholas Boylston (1747–1828),[1][2][3][4] a man of wealth and refinement, an officer of the Crown, and philanthropist. Boylston, who was a descendent of Zabdiel Boylston,[5] was born in Boston and spent much of his life in it. The Boylston Market was named after him as was the town of Boylston, Massachusetts.[3]

From west to east, Boston's Boylston Street begins at the intersection of Park Drive and Brookline Avenue as a two-way, six-lane road in Boston's Fenway neighborhood where it runs through three blocks of recently developed and currently under construction (as of 2015) high-rise, mixed-use buildings one block south of Fenway Park before forming the northern boundary of the Back Bay Fens at the Storrow Drive/Commonwealth Avenue right-of-way. Traffic traveling west on Boylston here cannot continue on Boylston Street, and must use Ipswich Street to continue west. Then, Boylston Street enters the Back Bay neighborhood where it becomes a major commercial artery carrying three lanes of one way traffic eastbound after Dalton Street. As it travels through the Back Bay, it forms the northern boundary of busy Copley Square and provides the southern limits to the Boston Public Garden before becoming a two-way street running along Boston Common's southern edge from Charles Street to Tremont Street. After Tremont Street, Boylston returns to carrying one way traffic east before ending at Washington Street in the downtown area where it changes to Essex Street.
