Utility Air Regulatory Group v. EPA: Oral Argument - February 24, 2014
Facts:
After the 2007 Supreme Court decision in Massachusetts v. EPA that determined that air pollution was subject to Environmental Protection Agency (EPA) regulation under the Clean Air Act, the EPA set out a series of standards governing greenhouse gas emissions. One of these benchmarks set emission standards for vehicles, while another one required stationary sources of greenhouse gases to obtain constructing and operating permits from the EPA. The petitioners, who include various state and industry groups, challenged these rules on the grounds that they were based on an improper construction of the Clean Air Act and are arbitrary and capricious because they are based on an inadequate scientific record. The U.S. Court of Appeals for the Federal Circuit dismissed the challenges.
Question:
Did the EPA permissibly determine that its regulation of greenhouse gas emissions from new motor vehicles under the Clean Air Act also triggered permit requirements for stationary sources of greenhouse gas emissions?
Conclusion:
No. Justice Antonin Scalia delivered the opinion for the 9-0 member majority. The Court held that, while the Massachusetts decision found that the Clean Air Act’s general definition of “air pollutant” included greenhouse gas emissions, it does not require the Environmental Protection Agency (EPA) to include greenhouse gas emissions every time the Act uses the term “air pollutant.” Instead, the EPA retains its ability to interpret the term in a context-appropriate way depending on where the term was being used. Because the inclusion of greenhouse gases as an “air pollutant” under the permitting scheme would compel the EPA to regulate tens of thousands of additional pollution emitters, it would not be reasonable for the EPA to interpret this specific instance of “air pollution” to include greenhouse gas emissions. Furthermore, even if the EPA were able to interpret this instance of “air pollution” to include greenhouse gases, the EPA lacks the authority to modify the threshold limits Congress dictated. Though the EPA overstepped its authority in trying to regulate greenhouse gases under this section of the Clean Air Act, the Court held that the EPA’s decision was within the boundaries of the EPA’s discretion.
Justice Stephen G. Breyer wrote an opinion concurring in part and dissenting in part in which he argued that the Clean Air Act’s language regarding which pollution emitters are required to obtain permits should not be read to include all pollution emitters. This interpretation would solve the tension between the majority’s position, which denies the ability of the EPA to regulate greenhouse gases in some cases, and the Court’s decision in Massachusetts , which explicitly held that greenhouse gases are subject to EPA regulation. Justice Ruth Bader Ginsburg, Justice Sonia Sotomayor and Justice Elena Kagan joined the opinion. In his separate opinion concurring in part and dissenting in part, Justice Samuel A. Alito, Jr. argued that Masschusetts had been wrongly decided and should be overturned. Furthermore, because the majority held that the term “air pollution” under the permitting requirement does not include greenhouse gas emissions, then the same phrase under the capture technology requirement should likewise be read to not include greenhouse gas emissions. Therefore, the EPA should not be allowed to require pollution-capturing technology for greenhouse gas emission. Justice Clarence Thomas joined the opinion.</p

H.R. Pufnstuf is a children's television series produced by Sid and Marty Krofft in the United States. It was the first Krofft live-action, life-size puppet program. The seventeen episodes were originally broadcast from September 6, 1969 to December 27, 1969. n 2004 and 2007, H.R. Pufnstuf was ranked #22 and #27 on TV Guide's Top Cult Shows Ever.
H.R. Pufnstuf introduced the Kroffts' most-used plot scenario: their fairy tale of good versus evil.The show centered on a shipwrecked boy named Jimmy (played by Jack Wild 1952 - 2006). He is 11 years old when he arrives on the island and turns 12 in the episode called The Birthday Party. Jimmy and his friend, a talking flute named Freddy, take a ride on a mysterious boat, which promised adventures across the sea, to kooky Living Island, home of dancing, talking trees and singing frogs.
The Mayor of Living Island was a friendly and helpful dragon named H.R. Pufnstuf (voiced by the show's writer Lennie Weinrib). The boat was actually owned and controlled by a wicked witch named Wilhelmina W. Witchiepoo (played by Billie Hayes) who rode on a broomstick-like vehicle called the Vroom Broom.
She used the boat to lure Jimmy and Freddy to her castle on Living Island, where she was going to take Jimmy prisoner and steal Freddy. But Pufnstuf found out about her plot and was able to rescue Jimmy when he leaped out of the enchanted boat with Freddy and swam ashore. Jimmy was taken in by Pufnstuf, who was able to protect him from Witchiepoo, as the cave where he lived was the only place her magic had no effect.

Jerry Garcia
Jerome John Jerry Garcia (August 1, 1942 – August 9, 1995) was an American musician who was best known for his lead guitar work, singing and songwriting with the band the Grateful Dead, which came to prominence during the counterculture era. Though he disavowed the role, Garcia was viewed by many as the leader or spokesman of the group.
One of its founders, Garcia performed with the Grateful Dead for their entire thirty-year career (1965–1995). Garcia also founded and participated in a variety of side projects, including the Saunders-Garcia Band (with longtime friend Merl Saunders), Jerry Garcia Band, Old and in the Way, the Garcia/Grisman acoustic duo, Legion of Mary, and the New Riders of the Purple Sage (which Garcia co-founded with John Dawson and David Nelson). He also released several solo albums, and contributed to a number of albums by other artists over the years as a session musician. He was well known by many for his distinctive guitar playing and was ranked 13th in Rolling Stone's 100 Greatest Guitarists of All Time cover story.

The 2016 Democratic National Convention was a presidential nominating convention, held at the Wells Fargo Center in Philadelphia, Pennsylvania, from July 25 through to July 28, 2016. The convention gathered delegates of the Democratic Party, the majority of them elected through a preceding series of primaries and caucuses, to nominate a candidate for president and vice president in the 2016 United States presidential election. Former U.S. Secretary of State Hillary Clinton was chosen as the party's nominee for president by a 59.67% majority of delegates present at the convention roll call, defeating primary rival Senator Bernie Sanders, who received 39.16% of votes from delegates, and becoming the first female candidate to be formally nominated for president by a major political party in the United States. Her running mate, Senator Tim Kaine from Virginia, was confirmed by delegates as the party's nominee for vice president by acclamation.
Delegates at the convention also adopted a party platform, through a voice vote, to take to the 2016 elections, touted as the most progressive platform in the Democratic Party's history. The progressive shift was often credited to Sanders and the influence of platform-committee members appointed by him. The platform featured a focus on economic issues, such as Wall Street reform, stronger financial regulation, and raising the minimum wage to $15 an hour. Liberal stances on social issues, such as a call for criminal justice reform and an end to private prisons, expansion of Social Security, and the abolition of the death penalty, also feature in the platform.
Senator Elizabeth Warren delivered the keynote address of the convention, with First Lady Michelle Obama and Bernie Sanders serving as headlining speakers on the first day. Former President Bill Clinton served as headlining speaker on the convention's second day, while Vice President Joe Biden and President Barack Obama headlined on day three. Tim Kaine gave his vice presidential nomination acceptance speech on the third day of the convention, while Chelsea Clinton introduced Hillary Clinton to give her presidential nomination acceptance speech on the final day. Clinton's speech was generally well received, and she would go on to have a 7% convention bounce in national polling. Various performers also appeared during the convention, including Demi Lovato, Alicia Keys, Lenny Kravitz and Katy Perry. The live announcer for the four-day event was Sylvia Villagran. Overall attendance at the convention was estimated to be around 50,000, according to Anna Adams-Sarthou, a representative of the DNC Host Committee.The convention was not without controversy, as it was subject to various conflicts between supporters of the presidential campaign of Bernie Sanders and the Democratic Party.
